1662 | Englisches Recht ist das in →England (seit 1330 auch in Wales, nicht dagegen ohne weiteres auch in Schottland und Irland) geltende Recht. Seinen Ausgangspunkt bilden die frühmittelalterlichen →Volksrechte (Gesetze) der →Angelsachsen. Mit dem Sieg der →Normannen unter Wilhelm dem Eroberer über die Angelsachsen (1066) wird das →angelsächsische Recht auf die örtlichen Gerichte beschränkt, während am Königsgericht (lat. curia [F.] regis, Königsrat, →Court of King‚s Bench [E. 13. Jh.] für Delikte, Strafen, Appellationen, →Court of Common Pleas für alle gewöhnlichen Klagen [1178], →Court of Exchequer für Abgabenstreitigkeiten [E. 13. Jh.]) und bei den dieses bzw. diese unterstützenden Reiserichtern eine übergeordnete, französisch (Law French) gehaltene commune ley (lat. communis lex [F.], gemeines Recht) Anwendung findet (→common law). Besondere Bedeutung erlangt hier der vom Kanzler des Königs dem Kläger ausgestellte, lateinisch abgefasste →writ (ver-fahrensrechtliche Weisung) an den Sheriff, von dem es bereits am Ende des 12. Jh.s etwa 75 bzw. 1227 56 verschiedene Arten gibt, die Ranulf de Glanvill († 1190) in dem (lat.) Tractatus (M.) de legibus et consuetudinibus regni Angliae (Traktat über die Gesetze und Gewohnheiten des Königreichs England) und Henricus de Bracton († 1268) in seinem Werk (lat.) De legibus et consuetudinisbus Angliae (Über die Gesetze und Gewohnheiten Englands) ordnen und darstellen. Wegen des Gewichts des Königsgerichts und der grundlegenden Bedeutung der vor ihm durch den writ eröffneten Verfahrensarten rückt der praktisch geschulte, ab 1200 namentlich bekannt werdende, bis etwa 1300 professionalisierte Richter im Mittelalter in den Mittelpunkt des Rechtes. Dieses wird (neben allgemeinen Bestimmungen wie der Magna Charta von 1215 oder den Provisions of Westminster von 1259 vor allem) durch Einzelurteile fortgebildet, in denen nur ausnahmsweise von einem Präjudiz abgewichen wird (amtliche Aufzeichnungen in Latein als records, nichtamtliche Aufzeichnungen durch junge Anwälte in Lawfrench von etwa 1290 bis 1536 in reports bzw. year books). Dabei kommt zum königlichen Gericht seit dem Spätmittelalter das Gericht des Kanzlers (→Court of Chancery) hinzu, das nach Billigkeit (→equity) urteilt (z. B. Anspruch auf vorbeugende Unterlassung, Anspruch auf Vertragserfüllung). In den Auseinandersetzungen zwischen König und Parlament im 17. Jh. stellen sich die praktisch in den inns of court ausgebildeten englischen Rechtes kundigen (z. B. Edward Coke [1552-1643], der in seinen Institutes of the Laws of England eine erste umfassende Darstellung des common law bietet) auf die Seite des Parlaments und festigen dadurch ihre Stellung. Im 18. Jh. entwickelt William Blackstone (1723-1380) in seinen Commentaries on the laws of England erstmals eine nach materiellen Rechtssätzen geordnete Darstellung des englischen Rechtes, das im Übrigen durch die Gewinnung von Kolonien auf viele Teile der gesamten Welt verbreitet wird (z. B. Vereinigte Staaten von Amerika, Kanada, Australien, Neuseeland, Afrika, Asien). Seit dem 19. Jh. gewinnt gegenüber den richterlichen Fallentscheidungen nicht zuletzt auch unter dem Einfluss Jeremy Benthams (1748-1832) das Gesetz (z. B. Judicature Act 1873/1875, Verbindung von courts of law und court of chancery zu einem supreme court of judicature mit high court of justice und court of appeal, Zusammenfassung der writs in einem einleitenden writ of summons) ein gewisses, mit dem Beitritt zu den Europäischen Gemeinschaften (1973) bzw.
